On a warm summer day, the New York City Police arrested a Bronx man for possession and sale of drugs, an all too common event, though there was a problem with this arrest. The man did not possess any drugs nor did he sell any drugs and the Police had no evidence of him selling or possessing any drugs. On a July afternoon, a man stood in front of his Bronx home when a street vendor asked if he wanted to buy some t-shirts. The man spoke to the street vendor for a few minutes and the vendor went on his way with no t-shirts sold. Minutes later, the police swooped in and arrested the street vendor and the man.

The street vendor did possess drugs and admitted so to the police. Nonetheless, there was no evidence of any sale between the two and our client possessed no drugs. The street vendor gave a statement declaring that he had not sold any drugs to our client.

Police transported our client to the nearest police precinct. There, they strip-searched, finger printed and photographed him. After they confiscated his phone, keys and ID, they detained him for three to five hours in a holding cell. He spoke with one of the arresting officers, telling the officer that he did not know anything about drugs or a drug deal.

The Police brought the man to Central Booking, where once again he was held for many hours. He was then brought to court and charged with felony drug sale. Bail was set at $2,500 so the man remained in jail for four days until he could make bail. He returned to court three times, before the charges against him were dismissed for lack of evidence.
