Arrest Made in 2004 Death on Sprain Brook Parkway

A Yonkers man accused of throwing chunk of asphalt that killed a woman.

 

Witnesses were horrified when they saw the 2004 accident on the Sprain Brook Parkway.

A chunk of asphalt smashed through the windshield of Marie McSweeney who was driving southbound near Kimball Ave in Yonkers with her 87 year-old mother in the passenger seat. McSweeney was hit and her car carreened down the parkway, hitting the shoulder guard rail and going nearly a third of a mile before it ended up in the trees off the Desmond Ave off-ramp.

Even more horrifying, the 10” x 7” x 3” block of asphalt had not accidentally fallen off a truck. The chunk of rock had been thrown off the Kimball Avenue Bridge overpass.

Both women were taken to Jacobi Hospital, but McSweeney would not survive and no one was arrested.

Five years later, the Yonkers police assigned its homicide and Cold Case investigators to shake loose the details of the case and finally find the person at fault for the fatal incident.

According to a statement from the Westchester County District Attorney's office, a Yonkers man, Alberto Plasencia, 26, has been charged today with one count of Murder in the Second Degree, a class “A-1” Felony in connection with McSweeney's death.
